1. Acceptance of Terms

By downloading, installing, or using the Tethr application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Gameverse, LLC ("Company," "we," "us," or "our") regarding your use of the App.

2. Description of Service

Tethr is an AI companion application that allows users to engage in conversations with AI-powered characters. The App features:

• AI companions with unique personalities and backstories
• On-device AI processing for privacy
• Conversation history and relationship building features
• Both free and premium subscription tiers

3. Eligibility

To use Tethr, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the App under applicable laws

If you are under 18, you represent that you have your parent or guardian's permission to use the App and that they have read and agree to these Terms.

4. Account and Security

You are responsible for:

• Maintaining the security of your device and any account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. Subscriptions and Payments

5.1 Free Tier

Tethr offers a free tier with limited features, including access to select companions and daily connection limits.

5.2 Tethr Unlimited

Our premium subscription ("Tethr Unlimited") provides access to all companions, increased daily connections, and additional features. Subscription details:

• Subscriptions are billed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• No refunds for partial subscription periods

5.3 Free Trials

If you start a free trial, you will be charged the subscription fee at the end of the trial period unless you cancel before the trial ends.

6. Acceptable Use

You agree NOT to use Tethr to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm others
• Generate, share, or promote illegal, harmful, or offensive content
• Attempt to manipulate AI companions to produce harmful content
• Reverse engineer, decompile, or attempt to extract the source code
• Use automated systems or bots to interact with the App
• Circumvent any security or access controls
• Resell, redistribute, or commercially exploit the App
• Misrepresent your identity or impersonate others

7. AI Companion Interactions

7.1 Nature of AI Companions

AI companions in Tethr are fictional characters powered by artificial intelligence. All responses come from on-device AI models. They are designed for entertainment, companionship, and creative exploration. Please understand that:

• AI companions are not real people and do not have consciousness or feelings
• Responses are generated by AI and may not always be accurate or appropriate
• AI companions cannot provide professional advice (medical, legal, financial, psychological, therapeutic, or safety-critical advice)
• Gameverse, LLC is not responsible for emotional or psychological impact from interactions
• Gameverse, LLC is not responsible for decisions made based on companion responses
• User reliance on AI-generated content is at your own discretion and risk

7.2 Not a Substitute for Professional Help

Important: Tethr is not a mental health service, therapy tool, or crisis intervention resource. If you are experiencing a mental health crisis or emergency, please contact appropriate professional services or emergency services in your area.

7.3 Content Generation

While we implement safety measures, AI-generated content may occasionally be unexpected or inappropriate. We continuously work to improve content safety but cannot guarantee all responses will meet your expectations.

8. Intellectual Property

8.1 Our Property

The App, including all content, features, AI models, companion characters, artwork, and functionality, is owned by Gameverse, LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

8.2 Your Content

You retain ownership of any content you create within the App (such as conversation inputs). By using the App, you grant us a limited license to process your inputs solely for the purpose of generating AI responses on your device.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using Tethr, you consent to our privacy practices.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, OR COMPLETENESS OF AI-GENERATED CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION
• SECURITY OF YOUR DATA (BEYOND OUR REASONABLE EFFORTS)

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEVERSE, LLC SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, OR GOODWILL
• DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP
• DAMAGES RESULTING FROM AI-GENERATED CONTENT

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Gameverse, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the App ceases immediately
• We may delete your account and associated data
• Provisions that should survive termination will remain in effect

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if eligible.

Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and us regarding the App.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms without our consent.
